I won an auction on a Thursday and shortly afterwards sent the payment via Paypal. Then on Saturday when I checked my emails, I found that another payment had been sent to the same seller for the same auction on Friday. Since we were not home at all on Friday and didn’t get on the computer, we didn’t send the double payment through Paypal. Confused I emailed Paypal and the seller notifying them of the mistake. I asked Paypal to refund the money since I did not send the double payment out. They said they couldn’t and that the seller would have to refund me. I let the seller know this (this was all done on Saturday, one day since the double payment). The seller finally wrote back a week later stating that she didn’t realize that she had received a double payment and had already spent the money that I would have to wait until she came up with the money through other auctions. It was only $23.30, that’s a small amount to come up with. It’s been three weeks now and I haven’t received the product nor the refund for the double payment. Should I count my losses even though it wasn’t my mistake? Frown How long should I wait to see if the seller follows through?

Most importantly, your seller had to have realized she was paid twice. I accept payments through Paypal and given that they keep a seller using their service updated on payments, she must've been contacted twice, particularly since you said the second payment went in some time (a whole day) after the original payment. I've had a few people click that Send Money button more than once and it always shows up on my end and it takes 2 seconds to cancel the transaction.

I would give her a deadline for which to refund your overpayment, regardless or face the consequences with eBay and Paypal. That is theft, plain and simple. Who gives a flying you-know-what if she needs to finalize more auctions to pay you? She shouldn't be spending money that isn't hers in the first place! She was probably hoping you wouldn't notice and was taking advantage of her little windfall.

Keep all documentation and be prepared to file your case with Paypal. Go to the Help section on their website and find the Buyer Complaint section there. Usually this pertains to sellers who don't deliver goods to buyers after receiving payment but maybe it help you recover your money.

I agree that you should give the seller a 72-hour deadline in an e-mail, after which you should proceed further. BUT I would recommend that you immediately file a fraud complaint with PayPal and eBay. PayPal will not look at ANY transaction after 30 days, regardless of the circumstances.

In order to initiate the complaint within the timeline, I would file TODAY. Indicate that you are willing to seek further resolution, but get opn record today, since you say that more the three weeks have already past.

And don't forget to leave appropriate feedback when the matter is resolved, hopefully well before the 90-day mark. Mad
Thankyou for your help. I sent notice as you both suggested along with an email to the seller letting her know of my actions. I don't know if ebay or Paypal contacted the seller but the seller finally refunded the extra payment today. Now, hopefully the item will arrive soon. It should have been here by now. But right now I'm just thankful that they refunded me.
