Won this auction (with Auction Sniper of course)3080049917 and I understand all the terms that are in it about WYSIWYG, as is, no returns and that I was taking a gamble. Thankfully I'm not out a fortune, about all I can do now is leave some type of feedback. Here's the deal:

The cable modem arrived this week. Works only through the USB port, not the Ethernet connection as desired. Every conceivable test has been done by me and the cable company to get the thing running. My NIC and cable aren't the problem.

The auction does state that some Toshiba diagnostics and install software is included, though this is not shown in the WYSIWYG photo. Toshiba states this software is on a CD. It is not downloadable and obtainable only by buying another modem. It could possibly help me get the thing running if I had what was listed in the auction. As it is, I have a Toshiba paperweight.

I contacted the seller yesterday & asked nicely if any type of software was to be included and explained my problem. Silence. Today I had a friend use their ebay account to ask the seller about one of his other auctions, he responded immediately.

I don't expect the seller to do much as he has the terms in his favor which leave me no option. I understood that when I bid. I could gripe about the software but why bother.

He left me positive feedback when I paid. I'm not looking for revenge, but what type of feedback would you leave this seller?

Their auction description definately states that the device both works with ethernet and includes software. I'd send another polite email stating you didn't get what the seller described, and would like a refund. If they balk you can complain to eBay (and paypal if you used them). For <$15 it might be more trouble than you want to go through, but the seller does have an obligation to be correct in their description.

As an aside ... you might want to talk to a senior tech from your isp. It might be as easy as them asking you for the 'mac' address of the device and enabling it on their end. I've found that, in general, the 'first contact' techs are little better than the people I always get at 'help' desks (turn your computer off and back on ... like I haven't done that a MILLION times!!!) Thanks, I guess it's worth a shot asking the guy about a refund, I haven't got anything to lose. About the MAC address...I called Charter first thing when I received the modem and got the new MAC going, that's why it's at least running on USB.

If only it had been the other way around, Ethernet but no USB- could have lived with that!
