I have another real hassle, and would really like some help. I have over 300 positive feedback on my account, and suddenly I seem to have a bunch of problems all at once. I sell a magazine occasionally on ebay that has a one off poster in the back that is quite collectible. I am currently listing just the poster, I sold the magazines but they wouldn’t shift, so I removed the poster and sold it separately, stating that it had been taken from a magazine. A guy who was a customer bought a bunch of multiple items off me that I was doing quite well on, using buy it now. Within the next month he basically started selling virtually every item that I do. Really annoying, but fair enough, open market and all that. Now though he has started listing this magazine, having sourced some copies – I would just go about my business, but for the fact that he uses virtually the entire listing to interfere and undermine mine…..the bulk of which is below :

You will notice other sellers on ebay who sell this poster separately and why do they do this, purely in the name of making a few quid, now what sort of genuine collector would do that?
The poster seems to sell in the region of £4 - £10, and then whats left of the magazine is sold for around £2-4 plus the postage for both items, raking in a total of nearly £20 !!! and what do you get, a magazine which is in my opinion worthless, as it is no longer in its original condition.
So heres my offer, i have listed the magazine with a reserve, purely because i believe it should be sold as a whole, not cut up for profit, so you, the winning bidder will be receiving the magazine in its full glory, making it well worth adding to your collection especially when you consider the rarity of finding one fully intact.
The magazine i am offering is in superb condition, all in full colour, see below for a full list of articles in this issue. Perhaps after reading this, those so called collectors who are guilty of the above will feel ashamed and sell the item as it should be, FULLY INTACT.

I have emailed the seller and suggested that this is damaging to me as a seller, and designed to do so - and that I would really appreciate it if he just sold the item on its merits - but he will not respond. I am wondering whether it is worth contacting ebay, does his listing break any listing policies ? The item is a really small “niche” poster and it is quite clear who the seller is referring to – we seem to be the only sellers offering this item on ebay at this time and as he now sells virtually the same items I do, we deal with a lot of the same customers and I feel it is quite damaging, and designed to do so. I could really do with some help.

Is there any ebay help pages I could check ?, I looked at the users agreement

http://pages.ebay.co.uk/help/policies/user-agreement.html

which states under "restrictions"

do you think anything like this could apply ? he does not mention me directly, but who it applies to is quite obvious - sorry about the length of thread, this one has me stumped

Hmmm - it would appear that you are up the preverbial poopoo creek without a paddle!!

He doesnt seem to have breached any of ebays rules and regs and even if he has, it can be hard to get ebay to act on it.

Depending your nature, you might want to reword your listing to point out the advantages of NOT buying the poster with the magazine....cheaper shipping, cluttering up your house etc etc. I wouldnt stoop to his level, but it cant hurt to level the playing field a little.

Curious, are his items selling well? You did say you couldnt sell yours ?
It was harder to sell them when they were pictured as the magazine with the poster folded out, I think because some people only wanted the poster. The rest of the magazine is nothing special. Its a pan for me because I don't really want to get into a they say - I say war on listings, I think its inappropriate. Also I dont want to change the way I sell because some bugger thinks he has the right to dictate how I should.
Possibly too late, but here is what you should do.

Go here: http://pages.ebay.co.uk/help/policies/transaction-interference.html

Click on the 'contact us' link on the left hand side. When you get to the next page you will see a form with three boxes. Use the following options in each of the three boxes:

1) Report Problems With Other eBay Members

2) Problems With Buyers

3) User is emailing buyers to warn them about seller or item

Not exactly right, I know, but this is probably as close as you can get to your specific problem. The guy was a buyer from you at one point, so this should help with your claim. It certainly is auction interference, but my faith in eBay to amend this is very minimal at best.

Best of luck with this - I hope eBay will help by removing those appalling listings for you.
