Looks like this behavior is common for this seller (see e-mail below). Here's what I did in order to receive the refund.
I think there is a 20 day limit for sellers to ship an item.
After 30 days you may file a fraud claim with e-bay if you
haven't received.
I sent him 2+ e-mails per week through squaretrade with
"refund" as one of the methods of resolution. I counted
Down the days until I could file a fraud case and told
Him that there was still a way to get out without negative
feedback.
He offered to ship the system immediately or to give a
refund (he had already promised (a week prior) to ship the
system the same day... This time, he gave the service tag
so I actually had a reason to believe him. I
can't prove it, but I really don't believe he had the
notebook until that day. I still asked
for a refund.

Hi,
My name is XXXXXX. I bought a dell laptop from "XXXX" at ebay in April, too. It's been a month and I haven't got my item yet. I feel so tired of the slow transaction and email responds.
I saw you posted that you already cancelled the transaction and got the refund. I want to do the same thing. Could you please tell me how you did this? Is it ok that I just say I don't want to wait and ask him for the refund?? It would be appreciated if I can hear your experience negociating with XXXX. Thank you so much for reading this email.
Sincerely,
XXXXXX
